The Moreau Law Firm, PLLC (the "Firm," "we," "us," or "our") respects the privacy of visitors, members, and customers who use www.themoreaulawfirm.com, its member areas, and the Firm's educational membership programs (together, the "Website"). This Privacy Policy explains what information we collect, how we use and share it, how long we keep it, and the choices available to you.

1. Scope

This Privacy Policy applies to personal information collected through the Website, including member accounts, membership checkout, the Member Resource Center, member community features, live educational sessions, recordings, website forms, email and newsletter subscriptions, and cookies.

It does not govern information the Firm receives in the course of representing a client. Client information is protected by the client's engagement agreement and the Firm's professional duties of confidentiality, which are stricter than this policy. Information you send before signing an engagement agreement is handled under this policy and is not treated as confidential or privileged (see the Terms & Conditions).

2. Legal Intake Is Separate

The Firm uses a separate professional workflow, including its practice management system, for legal intake and client matters. The membership area is not a legal client portal.

Please do not submit Social Security numbers, tax returns, financial account numbers or credentials, detailed legal documents, confidential communications, medical information, government identification numbers, or other sensitive information through the member community, live-session chat, website forms, or other general Website features.

3. Information We Collect

Information you provide

  • Contact information, such as your name, email address, telephone number, business name, and general location

  • Account information, such as your login email, password (stored by our platform in protected form), display name, profile details, and preferences

  • Transaction and subscription information, such as the membership purchased, purchase date, amount paid, renewal schedule, cancellation status, payment status, billing history, fee waivers, and the type and last four digits of your payment card (full card numbers are collected and processed by our payment processor and are not stored by the Firm)

  • Communications, such as questions, support requests, feedback, survey responses, and messages about your membership

  • Community content, such as posts, comments, and reactions

  • Live session participation, such as your display name, profile image, chat messages, questions, reactions, and, if your camera or microphone is on, your image and voice

Information collected automatically

  • Device and browser information, IP address, and general location derived from your IP address

  • Pages viewed, links clicked, referring page, dates and times of visits, and session information

  • Information collected through cookies and similar technologies, including your cookie preferences (see our Cookie Policy)

Information from third parties

  • Payment confirmations and payment status from our payment processor

  • Attendance records (such as join and leave times) from our video conferencing provider

4. Live Sessions, Recordings, and Transcripts

Member live sessions are hosted on Zoom and recorded. Recordings may capture display names, chat messages, and the image and voice of any participant whose camera or microphone is on. Recordings are hosted in the Member Resource Center and are available only to members eligible to access them under the Membership Terms. We may use automated transcription or summary features to create transcripts or summaries of sessions.

We keep each recording for no more than 12 months after the session date and then delete it, including any copy held by our video conferencing provider. We do not use recordings, or your name, image, or voice, outside the Member Resource Center (for example, in marketing or testimonials) without your separate written consent.

5. How We Use Information

We use personal information to:

  • operate and maintain the Website;

  • create and administer accounts and provide purchased membership benefits;

  • process purchases, recurring subscriptions, cancellations, and refunds;

  • send transaction confirmations, renewal reminders, billing notices, session notices, and policy updates;

  • schedule and administer live sessions and manage recording access;

  • operate community features;

  • respond to inquiries and provide support;

  • protect Website security, prevent fraud and misuse, and enforce our terms;

  • understand how the Website is used and improve the Website and our educational resources;

  • send marketing email where permitted, which you may opt out of at any time;

  • evaluate requests for legal services and run conflict-of-interest checks, if you ask about legal services; and

  • comply with legal, tax, accounting, and professional obligations, and establish, exercise, or defend legal rights.

6. Member Questions and Content Development

Questions submitted for live sessions help us identify topics of broad interest. We may use the general subject matter of member questions to improve resources, FAQs, presentations, checklists, and future content. Before doing so, we remove names and identifying details, and we do not publish a member's personal facts. Submitting a question does not create an attorney-client relationship.

7. How We Share Information

We do not sell personal information. We do not share personal information for targeted (cross-context behavioral) advertising, and we do not use advertising pixels or cross-site tracking technologies on the Website.

We share personal information only as follows:

  • Service providers that help us operate, under terms limiting their use of your information: Wix.com (website hosting, member accounts, membership billing, payment processing, community, video hosting, forms, and email), Zoom (live sessions and recordings), and Google Workspace (email and file storage).

  • Our practice management system, only if you request legal services or become a client, for intake, conflict checks, and client management.

  • Other members, who can see your display name, your community posts, and your participation in session recordings as described in Section 4.

  • Professional advisors, such as accountants, auditors, and insurers, under duties of confidentiality.

  • Legal and safety purposes, when we believe disclosure is required by law, subpoena, or court order, or is reasonably necessary to protect the rights, property, or safety of the Firm, our members, or others, or to investigate fraud or violations of our terms.

  • Business transfers, in connection with a merger, reorganization, sale, or transfer of all or part of the Firm or its programs, subject to applicable law and rules of professional conduct.

  • At your direction, or with your consent.

8. Cookies

We use cookies and similar technologies for essential operation, functionality, and aggregate analytics. Details and your choices are described in our Cookie Policy. Because we do not sell personal information or engage in targeted advertising, browser signals such as Do Not Track and Global Privacy Control do not change how we process your information.

9. Email and Text Messages

Email. We send transactional emails related to your account, purchases, and membership. Every marketing email includes an unsubscribe link. Unsubscribing does not stop transactional or account messages.

Text messages. We send text messages only to people who have consented to receive them, and accepting our Terms & Conditions, Membership Terms, or this Privacy Policy is not that consent. Consent to receive texts is not a condition of any purchase. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time or HELP for help. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent will not be shared with any third parties.

10. How Long We Keep Information

  • Account and membership information: while your account is active and up to 3 years after your membership ends

  • Purchase, billing, and tax records: as long as needed for tax, accounting, and legal purposes (generally up to 7 years)

  • Session recordings: no more than 12 months after the session date

  • Community posts: until deleted by you while your membership is active, by us, or at your request after your membership ends

  • Inquiries and form submissions: up to 3 years, unless you become a client, in which case they become part of the client file and are kept under the Firm's file-retention policy

  • Unsubscribe and opt-out records: as long as needed to honor your choice

We may keep information longer when required by law, a litigation hold, or professional obligations, or when needed to resolve a dispute, prevent fraud, or enforce our agreements. When information is no longer needed, we delete or de-identify it.

11. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information, and we rely on established platform providers for hosting and payment processing. Payment card data is handled by our payment processor under industry security standards. No website, network, or transmission method is completely secure. You are responsible for keeping your login credentials and devices secure. If a security breach affects your personal information, we will provide notice as required by the laws of Texas, Oklahoma, Wyoming, and any other state whose law applies.

12. Your Privacy Choices and Requests

Regardless of where you live, you may ask us to:

  • confirm whether we hold personal information about you and provide a copy;

  • correct inaccurate personal information;

  • delete personal information; and

  • stop sending you marketing email or text messages.

To make a request, email website@themoreaulawfirm.com with "Privacy Request" in the subject line, or call 469-289-2992. We will verify your identity before acting, usually by confirming control of the email address on your account, and we will not ask for more information than the request reasonably requires. We will respond within 45 days, and if we need more time (up to an additional 45 days), we will tell you why.

If we deny a request, we will explain why. You may appeal by replying with "Privacy Request Appeal" in the subject line, and we will respond to your appeal within 60 days.

Some information cannot be deleted on request, including records we must keep for legal, tax, or accounting purposes, information needed to complete a transaction or resolve a dispute, and session recordings (which are deleted on the 12-month schedule in Section 4). Deleting your account information ends your membership.

If you live in a state whose consumer privacy law applies to the Firm, you may have additional rights, and we will honor them as that law requires. We will not discriminate against you for exercising a privacy right.

13. Children

The Website and memberships are intended for adults 18 years of age or older. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us personal information, contact us and we will delete it.

14. Users Outside the United States

The Website and memberships are directed to users in the United States. If you access the Website from another country, your information will be processed in the United States and by our service providers in the locations where they operate.

15. Third-Party Websites

This Privacy Policy does not govern third-party websites or services that you access separately. Review their privacy policies before providing information to them.

16. Changes to This Policy

We may update this Privacy Policy to reflect changes in law, technology, vendors, or our practices. The updated policy will show a revised "Last Updated" date, and we will notify members by email before material changes take effect.
